Terms of use · 1. Scope

These terms of use and terms of sale govern your use of the Cairnfit mobile app and, for the sale part, your subscription. They are entered into between you and [[TO BE COMPLETED AT REGISTRATION: LEGAL NAME]], the entity that will run Cairnfit once registered (see our legal notice for its full identification). Creating an account means accepting these terms.

Terms of use · 2. Account creation and eligibility

You create an account with your email address (a one-time sign-in link or a 6-digit code) or by signing in with Google. An account is personal: you are responsible for keeping your credentials confidential and for everything that happens from your account.

Taking out a paid subscription is a contractual commitment: you need to have reached the age of legal majority in your country of residence, or have a legal guardian accept on your behalf, to agree to it. Cairnfit is not designed for young children.

Terms of use · 3. Acceptable use

You can use Cairnfit for your own training. You agree not to:

• Try to get around the coach's availability limits or the billing mechanics behind them.
• Use the app for anything unlawful, or for unlawful content.
• Copy, decompile, or try to extract how the app or the coach works.
• Impersonate someone else, or share your account with someone else to get around a subscription tier.
• Automate interactions with the coach at a scale beyond normal personal use.

Terms of use · 4. Your coach is AI-generated, and is not medical advice

Cairnfit's coach runs on Anthropic's Claude API (see our privacy policy for the detail of that transfer). Its replies are generated automatically from your training history and what you tell it: it is not a healthcare professional, and it is not medical advice.

Cairnfit is a training companion, not a medical device. If you have a health concern, talk to a qualified professional before starting or changing a training program.

Terms of use · 5. Your data and your rights

What Cairnfit collects, why, and your rights over it (access, export, deletion, objection) are detailed in our privacy policy. You can export or delete your data at any time from Settings.

Terms of use · 6. Suspension and termination

You can delete your account at any time from Settings: this permanently and immediately erases your data (see our privacy policy).

We can suspend or terminate your access if you violate these terms, in cases of fraud or abuse, or where the law requires it. If you have an active paid subscription, cancelling it on the store side follows the terms-of-sale section below.

Terms of use · 7. Liability

Cairnfit is provided as is, in beta. The coach can get things wrong: its training recommendations do not replace your own judgment or a healthcare professional's advice, and you remain responsible for how you train.

To the extent the law allows, our liability is limited to direct, foreseeable damage resulting from normal use of the app. Nothing in these terms excludes liability that cannot lawfully be excluded, including for gross negligence or willful misconduct.

Terms of sale · 1. Subscriptions and what they include

Cairnfit offers three tiers. The prices below are the ones published today on our pricing sections; they will apply once purchasing opens (see the banner at the top of this page).

Paid subscribers (Coach and Personal Coach) can also buy an immediate top-up ("Reset now") to finish a cycle early: a one-time, non-recurring purchase, priced at roughly a third of their tier's own monthly price.

Purchasing is switched off in the app as of today: none of these tiers can actually be bought yet. This table describes what will be offered once purchasing opens.

Terms of sale · 2. Buying through the App Store and Google Play

Cairnfit's subscriptions and one-time top-ups are sold through Apple's App Store or Google Play, depending on your device. Apple and Google act as merchant of record for these purchases: they process your payment, set their own terms for that transaction, and Cairnfit never sees your card details or billing information.

Terms of sale · 3. Billing and renewal

Coach and Personal Coach subscriptions renew automatically every month, at the then-current price, on the payment method on file with Apple or Google, unless you cancel before the renewal date. Any price change is notified to you in advance, following the relevant store's own rules.

Terms of sale · 4. Right of withdrawal (14 days)

As a consumer within the European Union, you generally have 14 days to withdraw from a purchase made at a distance, without needing to give a reason (Article L221-18 of the French Consumer Code; the EU Consumer Rights Directive).

That right has an exception for digital content not supplied on a physical medium, once its performance has started with your prior express consent and you have acknowledged losing your right of withdrawal as a result (Article L221-28, 13° of the French Consumer Code). In practice: if you consent to immediate access to coaching at the point of purchase, you can lose your right of withdrawal as soon as the subscription starts. Apple and Google, as merchants of record, apply this rule through their own purchase flow.

If you want to exercise your right of withdrawal, the request goes through Apple or Google, since they hold your payment method and are the ones who can issue a refund: see the next section.

Terms of sale · 5. Refunds

Refunds are handled directly by Apple (via reportaproblem.apple.com or Apple Support) or by Google Play (via the Play Store's own refund flow), following each store's own policy. Cairnfit does not have access to your payment method and does not process refunds itself.

Terms of sale · 6. Cancelling your subscription

You can cancel your subscription at any time from your app store's own subscription management: on iOS, Settings, then your name, then Subscriptions; on Android, the Play Store, then Payments and subscriptions. The Manage button in Cairnfit's Subscriptions screen opens that same native screen directly.

Cancelling stops the next renewal, but does not refund the period already paid for: you keep access until the end of the current period.

Terms of sale · 7. Applicable law, mediation and disputes

These terms are governed by French law, without prejudice to any mandatory consumer-protection rule of your own country of residence if you are a consumer within the European Union. In the event of a dispute, and absent an amicable resolution, French courts have jurisdiction, subject to the same reservation.

Consumer mediator: [[TO BE COMPLETED AT REGISTRATION: CONSUMER MEDIATOR NAME AND CONTACT DETAILS]]. This designation, mandatory for a site that sells to consumers, cannot be made before the company is registered.
